چکیده
جرائم علیه تمامیّت معنوی به رفتارهایی گفته می شود که موجب آسیب به شرافت، حیثیّت، ناموری و همچنین آزردگی روحی، روانی، فکری و احساسی انسان می شود. گسترش جرائم از این دست در فضای مجازی نیازمند اتّخاذ سیاست جنایی خاصّ خود و جرم انگاری مطلوب و بجا در این زمینه می باشد. این تحقیق که به روش توصیفی - تحلیلی و با استفاده از داده های کتابخانه ای انجام شده است در پی جوابی مناسب برای این سؤال است که چگونه می توان این اقدامات را جرم انگاری نموده و مقابله با آن چگونه است؟ یافته های تحقیق حاکی از این است که مبانی شرعی نظیر آیات و روایات و برخی قواعد فقهیّه، اصل لزوم جبران خسارت معنوی را توجیه می کند؛ ضمن این که سیاست سرکوبگرانه نسبت به این دسته از جرائم، تنها راه مقابله با این آسیب جدّی می باشد.Crimes against spiritual integrity in cyberspace with an approach to the crime of insult and defamation
Crimes against spiritual integrity are behaviors that cause damage to the honor, dignity, infamy, as well as mental, psychological, intellectual and emotional annoyance of a person. The spread of such crimes in cyber space requires the adoption of its own criminal policy and proper criminalization in this field. This research, which has been carried out in a descriptive analytical method and using library data, is looking for a suitable answer to the question of how to criminalize these actions and how to deal with it. The findings of the research indicate that Sharia foundations such as verses and traditions and some jurisprudential rules justify the principle of the need to compensate for moral damage, while the repressive policy towards this category of crimes is the only way to deal with this serious damage.
