چکیده
زمینه و هدف: امنیت مالکیت از موضوعات مهم و مبنای توسعه اقتصادی است. بر همین اساس، هدف مقاله حاضر، بررسی تطبیقی و تحلیل اقتصادی میزان تضمین مالکیت در ایران بر مبنای شاخص بین المللی حقوق مالکیت است. مواد و روش ها: مقاله حاضر توصیفی تحلیلی است. مواد و داده ها نیز کیفی است و از فیش برداری در گردآوری مطالب و داده ها استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: یافته ها نشان داد در نظام حقوقی کشور، طرفین عقود و معاملات، به خاطر هزینه های مربوط به ثبت رسمی، تضمین ناقص و ضمانت اجرای نامناسب، نقل و انتقال عادی را ترجیح می دهند. ثبت معاملات در صورتی می تواند نفع کلی و شخصی بیشتری دربرداشته باشد و بر اساس معیارهای کارایی عمل نماید که اولاً تضمین مالکیتی ناشی از ثبت به شیوه ای کامل صورت گیرد و ثانیاً تعارضات و ابهامات قانونی حل شده و ضمانت اجرای مناسبی برای عدم ثبت معاملات مشمول ثبت اجباری در نظر گرفته شود. همین طور نقل و انتقالات عادی معاملات مشمول ثبت اجباری معتبر شناخته نشود و قابلیت معارضه با اسناد عادی را نداشته باشد. نتیجه : نتیجه اینکه در چنین شرایطی اجباری نمودن ثبت همراه با ضمانت اجرای حقوقی کارآمد که از جمله الزامات نظام حقوق مالکیت کشور است، رتبه منطقه ای و جهانی مالکیت در ایران را با رفع کاستی ها ارتقاء داده و تضمین و تثبیت حداکثری حقوق مالکیت را در کشور به همراه خواهد داشت.Applied Analysis and Economic Analysis of the Balance of Ownership Rights in Iran on a Specific basis Among the Owners of Ownership Rights
